These Terms and Conditions ("Terms") govern your use of our website, purchase of products through our online store, purchases made in person at markets, pop-ups, or retail locations, and registration for and attendance at any candle-making classes or workshops we host ("Classes"). Our products include handmade candles, mugs, wick trimmers, diffusers, and related home goods (collectively, "Products"). By placing an order, registering for a Class, or purchasing from us, you agree to these Terms.

Products

 

The Serenity Candle Co. sells handmade candles as well as complementary items including mugs, wick trimmers, diffusers, and other home goods. Some items are handmade by us; others (such as wick trimmers or certain mugs/diffusers) may be sourced from third-party manufacturers or suppliers.

 

For handmade items, slight variations in color, scent throw, size, glaze, or finish may occur between batches. These variations are natural characteristics of handmade goods and are not considered defects.

 

We make reasonable efforts to display accurate colors and descriptions, but actual products may vary slightly from images shown on our website or social media due to screen settings, batch variation, or supplier changes.

 

Product Safety Warnings:

 

Candles

 

Please read and follow all safety instructions included with your candle:

 

- Never leave a burning candle unattended.

- Keep candles away from children, pets, drafts, curtains, and other flammable objects.

- Trim the wick to 1/4 inch before each burn.

- Burn on a heat-resistant, stable surface.

- Do not burn for more than 3-4 hours at a time.

- Discontinue use when 1/2 inch of wax remains in the container.

- Keep the wax pool free of debris, matches, and wick trimmings.

- Never touch or move a candle while it is burning or the wax is still liquid.

 

Wick Trimmers

 

Wick trimmers have sharp cutting edges. Keep out of reach of children and use only for their intended purpose.

 

Mugs

 

Unless specifically labeled as microwave- and dishwasher-safe, treat mugs as hand-wash only and do not use in the microwave. Always check that any liquid is a safe temperature before drinking, and inspect mugs for cracks or chips before each use.

 

Diffusers

 

Follow any included instructions for filling and placement. Keep reed diffusers and diffuser oils away from children, pets, and flammable surfaces, and away from finished wood or painted surfaces that may be damaged by oil contact. If using an electric/ultrasonic diffuser, follow the manufacturer's electrical safety instructions and never leave it running unattended near water sources.

 

The Serenity Candle Co. is not liable for injury, property damage, or loss resulting from failure to follow these safety instructions or from misuse of any product.

 

Orders and Payment

 

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or errors in pricing or product information.

Prices are listed in [USD] and are subject to change without notice. The price charged will be the price displayed at the time of order confirmation.

Payment is due in full at the time of purchase. We accept payment methods, e.g., major credit cards, PayPal, Klarna, etc.

Sales tax will be applied where required by law.

 

Shipping (Domestic)

 

- We currently ship within the United States only.

Orders are typically processed within [3-5] business days. Processing times may be longer during holidays or high-demand periods.

Shipping times are estimates provided by the carrier and are not guaranteed. The Serenity Candle Co. is not responsible for delays caused by the shipping carrier, weather, or events outside our control.

- Risk of loss and title for products pass to you upon our delivery to the shipping carrier.

It is your responsibility to provide a complete and accurate shipping address. We are not responsible for orders lost or delayed due to incorrect address information provided by the customer.

Warm-weather notice:

Candles and diffuser oils can melt, warp, or become damaged in transit during hot weather. We are not responsible for melting or damage to these items caused by extreme temperatures during shipping, though we're happy to work with you on a case-by-case basis — contact us if this happens.

Fragile items:

Mugs and other ceramic/glass items are packaged to prevent breakage, but please inspect your order upon arrival and contact us immediately if anything arrives damaged.

 

Local & In-Person Sales

 

Products purchased in person at markets, pop-ups, or events are considered final sale unless otherwise stated at the time of purchase, except as required by applicable consumer protection law.

 

Candle-Making Classes

 

We offer in-person candle-making classes and workshops ("Classes") at locations agreed upon by The Serenity Candle Co & the customer at time of registration. The following terms apply in addition to the rest of these Terms whenever you register for or attend a Class.

 

Registration and Payment

 

- Class spots are reserved upon payment in full at the time of booking, unless otherwise stated.

- Class sizes are limited, and registration is on a first-come, first-served basis.

- You must provide accurate contact information at registration so we can reach you about any changes to the Class.

 

Cancellations, Rescheduling, and Refunds

 

- Cancellations made at least [72] hours before the Class date are eligible for a [full refund / credit toward a future class].

- Cancellations made within [24-48] hours of the Class date are non-refundable, but we're happy to help you transfer your spot to another person or reschedule to a future date, subject to availability.

- If we need to cancel or reschedule a Class (for example, due to low enrollment, illness, or weather), we will notify you as soon as possible and offer a full refund or the option to attend a rescheduled date.

- No-shows are not eligible for a refund or credit.

 

Age Requirements and Supervision

 

- Participants must be at least [18] years old to attend, unless otherwise stated for a specific "family" or "kids'" class.

- Participants under 18 must be accompanied by a supervising adult, who must also sign a waiver on the minor's behalf.

 

Assumption of Risk and Liability Waiver

 

Candle-making involves the use of open flames, hot wax, and hot equipment (such as melting pots and heat guns), which carry an inherent risk of burns, injury, or property damage even when proper safety precautions are followed. By registering for or attending a Class, you acknowledge and agree that:

 

- You understand and voluntarily assume all risks associated with candle-making, including but not limited to burns, spills, and allergic reactions to fragrance oils.

- You will follow all instructions given by The Serenity Candle Co. staff during the Class.

- You are responsible for disclosing any relevant allergies, sensitivities, pregnancy, or medical conditions that may affect your participation.

- To the fullest extent permitted by law, you release The Serenity Candle Co, its owners, and staff from liability for any injury or property damage arising from your participation in a Class, except to the extent caused by our gross negligence or willful misconduct.

- We may require you to sign a separate, more detailed liability waiver and assumption-of-risk form on the day of the Class before participating. If there is any conflict between that form and this section, the signed waiver will control for purposes of the Class.

 

Photography

 

Unless you tell us otherwise in writing before the Class, we may take photos or video during Classes for use in our marketing and on social media. Let us know at registration if you'd prefer not to be photographed.

 

Returns, Refunds, and Exchanges

 

- We want you to be happy with your purchase. If your item arrives damaged or defective, please contact us at [email protected] within 10 days of delivery with your order number and photos of the damage.

- Due to the nature of candles and diffuser oils as consumable/handmade products, we generally do not accept returns for change of mind, scent preference, or products that have been used or burned.

- Mugs, wick trimmers, and other durable goods may be returned unused and in original condition within 7 days for a refund or exchange, unless defective or damaged on arrival.

- Approved returns/exchanges/refunds will be processed within 5-10 business days of receipt an inspection of product(s) in question.

 

Intellectual Property

 

All content on our website and marketing materials: including logos, product photography, descriptions, and branding is the property of The Serenity Candle Co. and may not be copied, reproduced, or used without our written permission.

 

Limitation of Liability

 

To the fullest extent permitted by law, The Serenity Candle Co. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or misuse of our products. Our total liability for any claim related to a purchase shall not exceed the amount paid for the product in question.

 

Allergies and Sensitivities

 

Our candles and diffuser oils may contain fragrance oils, dyes, and other ingredients. If you have known allergies or sensitivities, please review ingredient information or contact us before purchasing. Discontinue use if you experience any irritation or adverse reaction.

Georgia Disclosures

 

The Serenity Candle Co. is based in Georgia, and these disclosures apply in addition to the sections above.

 

- Fair Business Practices Act:

These Terms, our pricing, and our product descriptions are intended to comply with the Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390 et seq.), which prohibits unfair or deceptive acts or practices in consumer transactions. We disclose all material terms including costs, shipping charges, and return conditions before checkout is completed.

- In-person sales (Cooling-Off Rule):

For purchases made away from our primary place of business such as at markets, pop-ups, fairs, or events for $25 or more, federal law (the FTC's Cooling-Off Rule) may give you the right to cancel the sale within 3 business days. If this rule applies to your purchase, we will provide the required written notice of cancellation rights at the time of sale.

- No general statewide return mandate:

Georgia law does not require retailers to accept returns; our return policy in Section 7 governs unless a product is defective or as otherwise required by law.

- Filing a complaint:

Georgia consumers may file a complaint with the Georgia Department of Law's Consumer Protection Division at consumer.georgia.gov if they believe these Terms or our practices violate Georgia consumer protection law.

 

Governing Law

 

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Acworth, Georgia.
